Bankruptcy Court for Filing Chapter 13 and Chapter 7

The Bankruptcy Court (s) serviced by the Weller Legal Group of lawyers, are contained in the Middle District of Florida. The Middle District of Florida Bankruptcy Court system covers ten (10) million of the States eighteen (18) million residents. Our Bankruptcy Court system is the sixth busiest in the United States. Congress created the Bankruptcy Courts by dividing the United States into Judicial Districts. There are at least one Judicial District in each State and some States have more than one. The Tampa Bankruptcy Court is located in the Middle District of Florida and is a lower or inferior Court to the Court of Appeals (28 US Code Section 41). If one does not like a Decision from the Bankruptcy Court then he can Appeal to the Court of Appeals. There are thirteen (13) separate Court of Appeals.  We are in the 11th Circuit which includes Alabama, Georgia, and Florida. From the Court of Appeals one can seek final Decisions from the US Supreme Court.

Bankruptcy Courts in other insular areas (other than States in the United States) are called Territorial Courts although they provided the same functions as the standard Bankruptcy Courts. Each Bankruptcy Court has a US Marshall who serves the court system.

A Bankruptcy Judge is Judicial Officer of the United States District Court appointed by the majority of the Judges of the United States Court of Appeals. The Bankruptcy Judges are not directly appointed by Congress. The Judicial Conference of the United States submits recommendations regarding the number of Bankruptcy Judges needed. Bankruptcy Judges are appointed to fourteen (14) year terms.

While most Bankruptcy Law is created by our National Congress and is therefore uniform throughout the United States, each Bankruptcy Court is different in its practices because a Bankruptcy Attorney often will have to apply State Laws and what are called Local Rules or Procedures in representing their Clients.

The origin of the Bankruptcy Court and Bankruptcy Laws can be said to date back to Medieval Italy where it was the practice that a businessman who did not pay his Debts would have his trading bench broken. From the Italian word for broken bench “banca rotta” comes Bankruptcy. Before the 20th Century, Bankruptcy Laws mostly favored Creditors and were involuntary. In 1542, under Henry VIII, a Bankruptcy person was considered a Criminal, and punishment for Bankruptcy ranged from imprisonment to death. Australia was originally created by England to be a Debtor Prison. Most of its inhabitants originally came from Bankrupt ancestors.

Go 1 75 North Get on the Crosstown Expressway (toll road). Get off at the Kennedy Exit. Take a right on North Florida Ave. Go four blocks. The courthouse will be on the right. OR Exit 60 West. SR 60 turns into Kennedy Blvd. Turn right on North Florida Ave. Go four blocks. The courthouse will be on the right.

From Brooksville or Dade City, including Bartow, Mulberry and Lake Wales
Go 1 75 South Take 1 275 South. Take Exit 44 and go south on Ashley Dr. Go left on Cass St. for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

From Clearwater, Largo or Palm Harbor, including New Port Richey, Pinellas Park, Safety Harbor and Hudson
'Take Highway 60 across Old Tampa Bay (Courtney Campbell Causeway). Follow Highway 60 East towards Tampa. Get on 1 275 North. Take Exit 44 and go south on Ashley Dr. Go left on Cass St. for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

From Lakeland and Plant City
Go 1 4 West Get on 1 275 South and get off at Exit 44. Go south on Ashley Dr. At Cass St. go left for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

From Lutz and Temple Terrace
Go 1 275 South Take Exit 44 and go south on Ashley Dr. Go left on Cass St. for three blocks. The courthouse is on the right at the cross street of North Florida Ave.

From St. Petersburg
Go 1 275 North Take Exit 44 and go south on Ashley Dr. Go left on Cass St. for three blocks. The courthouse is on the right at the cross street of North Florida Ave.
